After a decade of legal proceedings, a landmark decision is now imminent. On May 28, the Higher Regional Court of Hamm will deliver its ruling in the case of Saúl vs. RWE— a decision that could reshape corporate accountability in the face of the climate crisis.

Following two days of hearings in March, all eyes are now on the upcoming judgment in the case of Saúl vs. RWE, which could set a new precedent in climate litigation. The court has already made its groundbreaking stance clear: major emitters can be held liable for the effects of climate change.

At the heart of the case is Saúl Luciano Lliuya, a Peruvian farmer and mountain guide, who is taking on one of Europe’s largest energy companies. He argues that RWE's emissions have contributed to climate change, putting his hometown of Huaraz at risk of flooding due to glacial melting. After the lower court initially dismissed his claim, the Higher Regional Court of Hamm broke new ground by agreeing with Saúl’s legal reasoning—writing legal history that is now set to be elaborated on in its decision. It could pave the way for further litigation and for much-needed policy changes to hold carbon majors accountable for the true cost of their business models.
